Which trademarks are not registrable in the United Arab Emirates?

  1. The mark that is devoid of any distinctive characteristic or nature, or the mark that consists only of statements that are customary designations for goods, products and services, or usual drawings and ordinary images of goods and products.

  2. Any mark that violates public morals or contradicts public order.

  3. General logos, flags, and other symbols of the state, as well as any imitation of those logos, flags, or symbols.

  4. A mark that is merely a translation of a famous mark or another mark previously registered, if such registration is likely to cause confusion among consumers regarding the products distinguished by the mark or similar products.

Who has the right to register trademarks?

  • Citizens of the state, whether natural or legal persons, who engage in any kind of commercial, industrial, craft, or service activities.

  • Foreigners, whether natural or legal persons, who engage in any kind of commercial, industrial, craft, or service activities in the country.

  • Foreigners, whether natural or legal persons, who engage in any kind of commercial, industrial, craft, or service activities in any country that treats the state with reciprocity.

  • Public legal entities.

What are the penalties prescribed for violating intellectual property rights of trademarks?

Punishment with imprisonment and a fine of not less than five thousand dirhams, or one of these two penalties, are imposed on:

  • Anyone who forges a registered trademark according to the law or imitates it in a way that misleads the public, regarding the goods and services distinguished by the original mark, and anyone who uses a forged or counterfeit trademark knowing it.

  • Anyone who maliciously places on their products a trademark registered by another or uses that trademark without right.

  • Anyone who offers for sale or trading, or possesses with the intent to sell, products bearing a forged, counterfeit, or wrongfully placed trademark knowing it.
